The TPDES MSGP regulation applies to Texas facilities that conduct "industrial activities" exposed to rain or stormwater runoff and their associated SIC (Standard Industrial Classification) or NAICS (North American Industry Classification System) code is listed under Part II Section A. 1. (b) of the TXR050000.

    Why the Permit and SWPPP are Required? 

    When it rains, stormwater can pick up oil, metals, sediment, chemicals, debris, and other pollutants from industrial and similar types of sites and carry them into local bayous, creeks, rivers, and drinking water sources. 


    Because of this, federal and state regulations require certain facilities to

    The Regulatory Background — Simplified:

    • The EPA created stormwater rules under the Clean Water Act (CWA) - National Pollutant Discharge Elimination System (NPDES). 
    • Texas implements these rules through TCEQ’s Texas Pollutant Discharge Elimination System (TPDES) as delegated by the EPA.
    • The main permit for stormwater discharges associated with industrial activities is the TPDES Multi-Sector General Permit  MSGP(Permit No. TXR050000).
    • A Stormwater Pollution Prevention Plan (SWPPP / SWP3) is required to show how your facility complies with this rule.
